<p class="wp-block-paragraph">Se puede constituir en línea, no requiere notario en ciertos casos y parece sencilla de operar. Pero hay algo que muchos emprendedores descubren demasiado tarde: La simplicidad administrativa no elimina las obligaciones fiscales.</p>



<h3 class="wp-block-heading"><strong>La SAS es Persona Moral (aunque sea “simplificada”)</strong></h3>



<p class="wp-block-paragraph">Uno de los errores más comunes es pensar que la SAS funciona como persona física.No es así. Ante el Servicio de Administración Tributaria, la SAS es <strong>Legal Entity</strong>, y por lo tanto debe cumplir prácticamente las mismas obligaciones fiscales que otras sociedades.</p>

If you’re a freelancer, consultant, remote worker or small business owner from abroad, working (or planning to work) legally in Mexico, then <strong>RESICO</strong> (Régimen Simplificado de Confianza, “Simplified Trust Regime”) may be one of the most favorable tax regimes available to you.</p>



<h2 class="wp-block-heading">What is RESICO?</h2>



<p class="wp-block-paragraph">RESICO is a tax regime created under Mexican law (effective since January 1, 2022) that offers simpler compliance, lower tax rates, and fewer administrative burdens for eligible individuals.</p>



<p class="wp-block-paragraph">Under <a href="https://cfo-ready.com/resico-individuals-tax-haven-mexico/">RESICO,</a> individuals with annual gross income up to MXN 3.5 million (approximately USD 200,000, depending on exchange rates) may benefit from progressive tax rates that are generally lower and simpler than in other regimes.</p>

<h3 class="wp-block-heading">Deadlines for the return of the balance in favor</h3>



<p class="wp-block-paragraph"><strong>1. Automatic refund:</strong> When the return is filed correctly and without inconsistencies, the SAT may automatically issue a refund. In these cases, the deposit is usually made within an average of 12 business days after the return is filed.</p>



<p class="wp-block-paragraph"><strong>2. Manual refund request:</strong>&nbsp;If the refund is not processed automatically, a manual request must be submitted using the Electronic Refund Form (FED). In this case, the SAT has up to 40 business days to process and deposit the balance.</p>
