Platforms like Uber, Airbnb, Mercado Libre, Rappi and many others allow millions of individuals in Mexico to <strong>alienate assets</strong> either <strong>provide services</strong> through <strong>Internet</strong>However, this convenience also brings with it significant tax obligations.</p>



<p class="wp-block-paragraph">In this article I explain to you in a clear and simple way <strong>How the ISR works for individuals who operate through digital platforms</strong>, the applicable withholding rates and the options you have as a taxpayer.</p>



<h3 class="wp-block-heading">Who is required to pay income tax on digital platforms?</h3>



<p class="wp-block-paragraph">According to the <strong>Income Tax Law (LISR)</strong>, the <strong>Physical persons</strong> with business activity that <strong>sell goods</strong> either <strong>provide services</strong> through digital platforms they must comply with the payment of the ISR.</p>



<p class="wp-block-paragraph">Digital platforms act as <strong>retainers</strong> of this tax and they must deduct it from your income before paying you.</p>



<h3 class="wp-block-heading">What income tax withholding rates apply?</h3>



<p class="wp-block-paragraph">The ISR is withheld according to the type of activity carried out and the percentage varies as follows:</p>



<ol start="1" class="wp-block-list">
<li><strong>2.1%</strong> → Passenger transportation and goods delivery services.</li>



<li><strong>4%</strong> → Hosting services (Airbnb, for example).</li>



<li><strong>1%</strong> → Sale of goods or provision of services (Mercado Libre, Fiverr, etc.).</li>
</ol>



<p class="wp-block-paragraph"><strong>Important</strong>: Withholding applies <strong>on total income</strong> received through the platform, excluding VAT.</p>



<h3 class="wp-block-heading">Final payment option for income less than $300,000</h3>



<p class="wp-block-paragraph">If your income <strong>annual</strong> do not exceed the <strong>$300,000 pesos</strong>, you can choose to consider the <strong>ISR withholdings</strong> What does the platform do to you? <strong>final payments</strong>.</p>



<p class="wp-block-paragraph"><strong>What does this option entail?</strong></p>

<p class="wp-block-paragraph">You must send a <strong>notice to the SAT</strong> within the <strong>30 days</strong> after you receive your first income through digital platforms. Once this option is presented, it will be <strong>irrevocable</strong> during <strong>5 years</strong>.</p>



<h3 class="wp-block-heading">Obligations of digital platforms</h3>



<p class="wp-block-paragraph">Platforms, both Mexican and foreign, have the obligation to:</p>



<ol start="1" class="wp-block-list">
<li>Issue tax receipts to taxpayers for the withholdings made.</li>



<li>Withhold and pay the ISR to the SAT <strong>no later than the 17th</strong> of the following month.</li>



<li>Keep documentation of the withholdings made.</li>
</ol>



<p class="wp-block-paragraph">If the taxpayer does not provide his <strong>RFC</strong>, the platform will retain <strong>the 20%</strong> of ISR on their income.</p>



<h3 class="wp-block-heading">Penalties for non-compliance</h3>



<p class="wp-block-paragraph">Foreign platforms that do not retain or pay ISR during <strong>three consecutive months</strong> will face penalties such as:</p>



<ul class="wp-block-list">
<li>Temporary blocking of digital services in Mexico.</li>



<li>Fines according to the <strong>Federal Tax Code</strong>.</li>
</ul>

										<content:encoded><![CDATA[<p class="wp-block-paragraph">There are countless platforms, applications, internet pages, where their owners are residents abroad and do not have a permanent establishment in the country, which were not required to pay taxes in Mexico until 2020. </p>



<p class="wp-block-paragraph">For the purposes of the Value Added Tax Law, a digital service is defined as services that:</p>



<p class="wp-block-paragraph"><em>“They are provided through applications or content in digital format through the Internet or another network, fundamentally automated, and may or may not require minimal human intervention, provided that a consideration is charged for the aforementioned services”</em></p>



<p class="wp-block-paragraph">The digital services provided by residents abroad without a permanent establishment in the country that are included in the Value Added Tax Law are: </p>



<p class="wp-block-paragraph">a) Downloading or accessing images, movies, text, information, video, audio, music, games, including games of chance, as well as other multimedia content, multiplayer environments, obtaining mobile tones, viewing news on line, traffic information, weather forecasts and statistics.</p>



<p class="wp-block-paragraph">b) Those of intermediation between third parties that are suppliers of goods or services and the applicants thereof.</p>



<p class="wp-block-paragraph">c) Online clubs and dating sites.</p>



<p class="wp-block-paragraph">e) Distance learning or tests or exercises.</p>



<p class="wp-block-paragraph">When a resident abroad provides some of the digital services mentioned above to a resident in Mexico, they must comply with the following obligations:</p>



<p class="wp-block-paragraph">a) Register with the Federal Taxpayer Registry (RFC)</p>



<p class="wp-block-paragraph">b) Offer and collect, together with the price of their digital services, VAT </p>



<p class="wp-block-paragraph">c) Provide the SAT with information on the number of services or operations performed</p>



<p class="wp-block-paragraph">d) Calculate and pay VAT for the provision of digital services each calendar month </p>



<p class="wp-block-paragraph">e) Issue electronic invoices when the recipient of the service requests it </p>



<p class="wp-block-paragraph">f) Assign a legal representative and a domicile in Mexico </p>



<p class="wp-block-paragraph">g) Process the advanced electronic signature (e.firma) </p>



<p class="wp-block-paragraph">In case of non-compliance, the tax authority in Mexico has the power to temporarily block access to the provider&#039;s digital service until it complies with its tax obligations. </p>
