This amendment requires employers to provide&nbsp;<strong>chairs with backrests<\/strong>&nbsp;to workers who perform duties in a standing position, provided that the nature of the work allows it.<br>The reform began to be implemented&nbsp;<strong>180 days after its publication<\/strong>, that is, the&nbsp;<strong>June 17, 2025<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Implementation deadlines<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As of June 17, 2025, the Ministry of Labor and Social Welfare (STPS) has a deadline of&nbsp;<strong>30 days<\/strong>&nbsp;to issue the&nbsp;<strong>technical guidelines<\/strong>&nbsp;on the ergonomic risks associated with standing for prolonged periods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For their part, employers will have&nbsp;<strong>180 additional days<\/strong>, until the&nbsp;<strong>December 14, 2025<\/strong>, for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Adjust your internal regulations.<\/li>\n\n\n\n<li>Define rest times.<\/li>\n\n\n\n<li>Assign areas within the workplace for the use of chairs.<\/li>\n\n\n\n<li>Establish the processes necessary to correctly implement the measure.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Obligations for employers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The new provisions impose the following obligations on employers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Provide chairs with backrests<\/strong>\u00a0in sufficient numbers to allow workers to take regular breaks.<\/li>\n\n\n\n<li><strong>Designate a fixed space<\/strong>\u00a0within the workplace for the use of these chairs.<\/li>\n\n\n\n<li><strong>Prevent workers from standing<\/strong>\u00a0throughout the working day.<\/li>\n\n\n\n<li><strong>Incorporate into the internal regulations<\/strong>\u00a0the criteria on the frequency and duration of breaks.<\/li>\n\n\n\n<li><strong>Regulate rest times and the use of chairs<\/strong>\u00a0in coordination with the joint health and safety committees.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Objective of the law<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Silla Law seeks&nbsp;<strong>prevent occupational risks<\/strong>&nbsp;derived from prolonged work in a standing position, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Backache.<\/li>\n\n\n\n<li>Muscle fatigue in legs.<\/li>\n\n\n\n<li>Circulatory problems.<\/li>\n\n\n\n<li>Joint disorders.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This reform promotes healthier and more dignified conditions for those working in sectors such as commerce, services, and certain areas of industry.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Recommended measures<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Labor law specialists suggest that companies take the following actions to facilitate implementation of the law:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Conduct a diagnosis of the jobs<\/strong>, to identify in which functions the use of chairs is viable.<\/li>\n\n\n\n<li><strong>Acquire ergonomic furniture<\/strong>\u00a0that meets the minimum backup and security requirements.<\/li>\n\n\n\n<li><strong>Train staff<\/strong>\u00a0and the internal committees on the new rights and obligations arising from the reform.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Enforceability and sanctions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although the right to rest has been enforced since June 17, 2025, the sanctions will come into effect once:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The STPS issues the technical guidelines.<\/li>\n\n\n\n<li>The adaptation period granted to companies is met.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Penalties may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fines from 250 to 2,500 UMA<\/strong>, depending on the severity of the omission.<\/li>\n\n\n\n<li>In cases of repeat offenses, even\u00a0<strong>suspension of activities<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Silla Law represents an important step forward in workplace health and well-being in Mexico. Starting June 17, 2025, companies must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide chairs with sufficient back support.<\/li>\n\n\n\n<li>Establish a fixed rest area in your workplace.<\/li>\n\n\n\n<li>Include these measures in your internal regulations.<\/li>\n\n\n\n<li>Perform ergonomic diagnoses and train staff.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Although the deadline for full compliance with the regulations expires on&nbsp;<strong>December 14, 2025<\/strong>It is advisable for organizations to begin implementing them as soon as possible.
