{"id":720,"date":"2022-01-22T16:50:16","date_gmt":"2022-01-22T16:50:16","guid":{"rendered":"https:\/\/q1dapyf5zv.onrocket.site\/?p=720"},"modified":"2022-02-02T01:56:41","modified_gmt":"2022-02-02T01:56:41","slug":"como-crear-una-empresa-en-mexico-siendo-extranjero","status":"publish","type":"post","link":"https:\/\/taxid.mx\/english\/como-crear-una-empresa-en-mexico-siendo-extranjero\/","title":{"rendered":"How to create a company in Mexico as a foreigner?"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Create a company in Mexico without having to travel the country. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mexico has positioned itself in the 9th place in the ranking of attractors of<a href=\"https:\/\/taxid.mx\/english\/2022\/01\/20\/quieres-invertir-en-mexico\/\"> foreign investment<\/a> Worldwide. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In our firm we advise foreign investors in Mexico, and we have compiled the main doubts of said investors, which we present below:<\/p>\n\n\n\n<div class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Can I create a company in Mexico as a foreigner?<\/strong> <\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is yes, and it is easy to create the company without having to travel to the country, since apostilled powers of attorney can be used to sign the <a href=\"https:\/\/contadormx.com\/tag\/crear-empresa-en-mexico-extranjero\/\">incorporation of the company in Mexico<\/a> being a foreigner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company can be 100% constituted by foreign capital, and the shareholders may be natural persons (individuals) or legal persons (companies), the latter allowing the creation of the figure of &quot;subsidiary in Mexico&quot;. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is the &quot;apostille&quot;?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The apostille is the legalization of national documents for use abroad. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is to say, if two Colombian citizens need to set up a company in Mexico, they must &quot;apostille&quot; the powers of attorney in Colombia so that they have effects in Mexico and in this way their representatives in Mexico can sign the constitution of the company in the country, without the need to that these travel to Mexico to sign personally. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> \u00bf<strong>Can I physically sign the constitution of the company in Mexico?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, if you decide to travel to Mexico to sign your company personally, you can do it. Just remember to protect the immigration document provided when you enter the country, because with this you will verify your legal stay in Mexico, which will be required at the time of signing. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Can I be a sole shareholder in Mexico?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, Mexican law does not allow the establishment of foreign investment companies with a single shareholder, so a minimum number of two shareholders is required, whether natural or legal persons, regardless of whether they are both foreigners. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How do I obtain the Federal Taxpayer Registry (RFC)?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The RFC is the tax identification number of a natural or legal person in Mexico, which is essential to have economic activities in the country. You can obtain this physically in Mexico through your agent at<a href=\"https:\/\/taxid.mx\/english\/2022\/01\/20\/que-es-el-sat-y-el-imss-en-mexico\/\"> Tax Administration Service (SAT)<\/a>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00bf<strong>Do I need a domicile in Mexico?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The tax authorities in the country require that companies present a domicile in national territory.
