The Tax Administration Service (SAT) has increased collection through the use of invitation letters crossing information contained in the CFDI and the returns submitted by the taxpayer.

The use of invitation letters by SAT has become one of the most effective inspection tools used by the SAT, which represent a low cost of inspection since they transfer the burden of review to the taxpayer.

Some examples of invitation letters sent by the SAT are the following:

  • Invitation letter for declarations not presented.
  • cFirst invitation to clarify tax discrepancies.
  • Invitation letter to verify expenses.
  • Invitation letter to clarify omitted income.
  • Invitation letter for clarification of operations with related parties.

What to do if you receive an invitation letter from the SAT?

If you receive an invitation letter and avoid serious consequences, we always advise answering it within a period of 15 days from receipt.

We must verify the differences and, where appropriate, pay the differences generated as a result of said review, which must include the corresponding updates and surcharges.

In addition to the above, we always recommend accompanying our work papers and, where appropriate, complementary statements, as well as proof of payment with a free writing detailing the documentation and procedures of our review.

If the authority considers that the differences have been clarified or corrected, it will continue to close the case as "SUCCESSFUL", otherwise it will request additional information or indicate the reasons why it considers that the taxpayer's tax situation has not been corrected.

What happens if I ignore an invitation letter from the SAT?

The consequences of ignoring invitation letters could have significant consequences, such as:

  • Increase in tax amounts since each month they will increase due to updates and surcharges.
  • Fines.
  • Cancellation of the Digital Seal Certificate (CSD), which would not allow you to invoice.

Conclusions

We recommend that you carry out compliance and tax review activities on a monthly basis to avoid discrepancies with the SAT, in case you receive an invitation letter to contact an expert.
