As foreigners we can own a Mexican company, without the need to travel to the country, since apostilled or legalized powers of attorney can be used to sign the constitution of the company in Mexico as a foreigner.

The apostille is the legalization of national documents for use abroad. That is to say, if two Colombian citizens need to set up a company in Mexico, they must "apostille" the powers of attorney in Colombia so that they have effects in Mexico and in this way their representatives in Mexico can sign the constitution of the company in the country, without the need that they travel to Mexico to sign in person.

Here are the steps to create your company:

1. First of all, it is highly recommended to look for a bilingual firm of accountants or lawyers with whom we can advise, they can refer us to a notary public to start the process.
2. We will need a partner (it can be another citizen of any nationality or Corporation)
3. Request permission to set up the company from the Secretary of Foreign Affairs (SRE).
4. Articles of Incorporation: Document in which each general and detailed aspect of the company will be established.
5. Registration with the SAT (RFC): The SAT aims to collect taxes and monitor compliance with the tax obligations of taxpayers in the country. It is important that each partner or shareholder has their RFC (only in the case that they are Mexican citizens)
6. Enroll in the Mexican Institute of Social Security (IMSS): The objective of the IMSS is to organize and manage Social Security, which must guarantee access to health, medical assistance and protection of the means of subsistence of Mexican workers.
7. Opening of a bank account.
8. Obtain the electronic signature of the SAT (e.firma): Once you have the RFC you can obtain your electronic signature. With your e.signature you will be able to bill and present your tax returns.
9. Continuing to collaborate with an accountant or accounting firm will help us ensure that the company is in legal and tax compliance.
